Online Store Terms and Conditions

The following Terms and Conditions set out the general terms of sale applicable to our online store, available at movino.com, operated by Action Gear Brands Sp. z o.o., Niciarniana 2/6, Łódź 92-208, VAT ID: 7282850597, REGON: 388227378. The company’s share capital amounts to: 100,000 PLN.

The company is registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Łódź-Śródmieście in Łódź, 20th Commercial Division, under KRS number 0001071734.

1. Scope of Application

These Terms and Conditions apply to all orders placed through our online store. The offer in our online store is intended exclusively for Consumers.

A Consumer, in accordance with Article 22 of the Civil Code, is a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.

2. Contract Conclusion

The sales contract is concluded with Action Gear Brands Sp. z o.o.

The presentation of products in our online store constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code. To make a purchase offer, you need to place an order. Using the mechanisms available in our store, you can add selected products to your shopping cart and submit a purchase offer. The shopping cart and entered data can be modified before placing the order using the available functionalities and instructions displayed during the ordering process.

By clicking the confirmation and finalisation button on the order summary page, you place an order for the products in your shopping cart. After placing an order, you will receive an email confirmation acknowledging receipt of the order and its acceptance for processing. Upon receiving this confirmation, the sales contract is concluded.

3. Language and Storage of the Contract

The sales contract may be concluded in Polish.

We store the contract content and send you order details and our Terms and Conditions via email. You can also access order information through your customer account. The Terms and Conditions are also available on our website in a manner that allows you to obtain, reproduce, and store their content.

4. Product Delivery

In some cases, additional shipping costs may apply to the listed product prices. Ordered products are delivered via our partnered courier companies. Detailed information on available delivery methods, timeframes, and shipping costs is provided during the ordering process and in a dedicated information section on our website.

Products offered in the store are sold exclusively via shipping. Unfortunately, personal collection is not available.

5. Payments

The following payment methods are available in our online store:

Cash on delivery upon receipt of the parcel.

Electronic payments (e-payments) via an online payment service.

6. Right of Withdrawal

Consumers have the statutory right to withdraw from the contract, as specified in the withdrawal policy. The right of withdrawal also applies to natural persons entering into a contract directly related to their business activity if the nature of the contract does not indicate a professional purpose, as defined in the regulations governing the Central Register and Information on Economic Activity.

7. Complaints: Product Conformity / Defects

We are obligated to deliver goods free from defects. In the event of non-conformity of the goods with the contract, the Consumer is entitled to the rights specified in Chapter 5a of the Consumer Rights Act. Under these regulations, the Consumer may request the repair or replacement of non-conforming goods, submit a statement on price reduction, or withdraw from the contract.

We are liable for any lack of conformity revealed within 2 years of delivery unless a longer usability period has been specified for a particular product. In such cases, the longer period applies.

In case of non-conformity, the above provisions also apply to a natural person entering into a contract directly related to their business activity, provided that the nature of the contract does not indicate a professional purpose, as determined by the Central Register and Information on Economic Activity.

We take all necessary measures to ensure the proper functioning of our website and interface within the scope of current technical knowledge and commit to resolving any reported issues within a reasonable timeframe. This also applies to subscribing to our newsletter or creating a customer account, where such services are available. If reporting technical issues, please specify the type and date of the issue encountered.

9. Alternative Dispute Resolution

Consumers have the option of using out-of-court complaint and claim resolution methods. Information on accessing such procedures is available at: www.uokik.gov.pl under the "Consumer Dispute Resolution" section.

Additionally, at http://ec.europa.eu/consumers/odr, consumers can access the online dispute resolution platform (ODR). The ODR platform is a multilingual, interactive website for consumers and traders seeking an out-of-court settlement of disputes arising from distance contracts.

Using the above-mentioned alternative dispute resolution methods is voluntary and may only occur if both parties to the dispute (Consumer and Seller) agree.

None of the provisions of these Terms and Conditions are intended to infringe on the statutory rights of the Consumer. In the event of any inconsistencies between these Terms and Conditions and the Consumer’s statutory rights, the statutory regulations shall always apply in place of the disputed provisions of the Terms and Conditions.
